Initial Comments:


Based on the findings of an onsite unannounced complaint investigation survey completed April 4, 2023, Pristine Home Care LLC was found NOT to be in compliance with the following requirement of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

Consumer Rights

(a) The consumer of home care services provided by a home care agency or through a home care registry shall have the following rights: (1) To be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences, except where the health and safety of the direct care worker is at risk. (2) To receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services. Less than 10 days advance written notice may be provided in the event the consumer has failed to pay for services, despite notice, and the consumer is more than 14 days in arrears, or if the health and welfare of the direct care worker is at risk.

Observations:


Based on an on-site complaint investigation, consumer files, (CF), Direct Care Worker, (DCW), files, Complaint logs, Disciplinary action documents, monthly HHAeXchange Time Sheets, agency Time Sheets, interview with the Administrator, and office staff it was determined that the agency failed to provide services with reasonable accommodation of individual needs and preferences according to the Consumer's service agreement for one, (1), of three, (3) Consumer files reviewed. (CF #3).

Findings:

On April 4, 2023, from approximately 11:35 a.m., to 12:40 p.m., a review of the home care agency's complaint log, Monthly HHAexchange documents, Weekly Time sheets, three (3) Consumer files to include the subject of the complaint, and four, (4), Direct Care Worker files assigned to the Consumers was conducted regarding allegations that: On 3/22/2023, during the 5pm-11pm shift, the Aide left early at 7pm without notifying her. Without help getting in the bed, she was forced to sleep in her wheelchair, and on 3/27/2023 the aide scheduled from 5pm- 11pm did not show up, and was forced to sleep her wheelchair again.


On April 4, 2023, at Approximately 12:30 p.m., a review of CF #3, (subject of the complaint), revealed a start of service on February 27, 2023. CF #3 receives 167 hours a week, (24 hours a day). A review of two (2), Documents Titled, HHAexchange Patient Calendar for the months of February 1, 2023 through February 28, 2023, and March 1, 2023 through March 31, 2023, revealed on that March 22, 2023 DCW #4 was scheduled to work from, 1745 until 2312, military time. The DCW visited from 1751 until 2312. DCW #4 clocked-in 6 minutes late, and clocked-out 3 minutes early. There was no evidence that the DCW left the assignment at 7:00 pm. On April 4, 2023, a further review of a document, Titled "HHAexchange Patient Visit Notes," dated March 22, 2023 revealed that at 2300 a DCW visited the premises but could not get in. A further review revealed that on March 27, 2023 CR #3 was again assigned the 11pm-6 am shift, but did not make the visit. There was no documented reason for the missed shift. A continued review of documents Titled, "Caregiver Time Sheets," revealed no time sheets for the dates or time in question.

On, April 4, 2023, at approximately 1:40 p.m., in an interview with the Administrator and office staff, it was confirmed the above findings.






Plan of Correction:

Pristine Home Care is committed to complying with the PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries regulation. As such, to prevent future related incidents, Pristine Home Care will implement the following plan of corrections. The Business Director will be responsible for monitoring the continued implementation of the plan of correction.
1. The agency will involve participants in the decision making of assigning caregivers in the form of meet and great and over the phone interview prior to start to start of service or any change in caregivers.
2. Pristine Home Care will ensure the participant and the participant's family members have the agency's contact number and on-call personnel number so informed communication occurs when there is no caregiver present.
3. The agency will develop a back-up plan with the participant to have informal consent in the event that the agency is unable to staff.
